Terms of Service

1. Acceptance of terms

By accessing or using Orbtium ("the Service"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, you may not use the Service.

Orbtium Ltd ("we", "us", "our") reserves the right to update these terms at any time. We will notify you of material changes by email or by displaying a notice in the app. Continued use of the Service after changes take effect constitutes acceptance of the revised terms.

2. Account

You must be at least 16 years of age to create an account. You are responsible for maintaining the confidentiality of your password. Because Orbtium uses zero-knowledge encryption, your password also functions as your encryption key derivation input — if you lose your password, your encrypted data cannot be recovered by us or by anyone else.

You are responsible for all activity that occurs under your account. Notify us immediately at security@orbtium.com if you suspect unauthorized access.

We reserve the right to suspend or terminate accounts that violate these terms, with or without notice, depending on the severity of the violation.

3. Acceptable use

You agree not to use the Service to:

• Store, transmit, or distribute content that is illegal under applicable law
• Attempt to reverse-engineer, decompile, or circumvent any security measures
• Conduct automated scraping, bulk data extraction, or denial-of-service attacks
• Impersonate any person or entity or misrepresent your affiliation with any entity
• Use the Service for any purpose that violates the rights of others

We do not monitor the content of your encrypted nodes — and technically cannot. However, we may terminate accounts on credible reports of serious illegal activity, and we will comply with lawful court orders to the extent technically possible (which, given our zero-knowledge architecture, is limited to account metadata).

4. Service availability

We strive for high availability but do not guarantee uninterrupted access to the Service. Scheduled maintenance, infrastructure events, or circumstances beyond our control may cause downtime. We will communicate planned maintenance in advance where possible.

The Free tier is provided "as-is" with no uptime commitments. Pro tier subscribers will receive service level details in their subscription agreement.

We reserve the right to modify, suspend, or discontinue any feature of the Service at any time. If we discontinue the Service entirely, we will provide at least 90 days' notice and a data export mechanism.

5. Limitation of liability

To the maximum extent permitted by applicable law, Orbtium Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, loss of profits, or loss of goodwill, arising out of or in connection with your use of the Service.

Our total aggregate liability for any claim arising under these terms shall not exceed the greater of (a) the amount you paid to us in the 12 months preceding the claim, or (b) £50.

Nothing in these terms excludes or limits liability for death or personal injury caused by our negligence, fraud, or any liability that cannot be excluded by law.

6. Changes to terms

We may revise these Terms of Service from time to time. The date of the most recent revision is shown at the top of this page. For material changes, we will provide at least 14 days' notice by email before the changes take effect.

If you do not agree to the revised terms, you may delete your account before the changes take effect. Continued use of the Service after the effective date constitutes acceptance.
